Retaliation

Employers may not take action against employees who report what they believe to be illegal activity occurring in the workplace.  Some common examples of when unlawful retaliation occurs is after employees do one or more of the following:

  • Complain to a manager or government agency about discrimination or harassment they or a co-worker are experiencing
  • Complain to a manager or government agency that they are not being paid owed wages or overtime
  • Complain to a manager or government agency about workplace safety issues
  • Report fraud or other illegal activity to a manager or law enforcement
  • Organize to increase their pay or improve their working conditions
  • File a discrimination, wage and hour, or false claims act lawsuit
